The terms

These terms apply to photography and film commissions accepted by DevantayJ (Raheem James), produced by Love and Escapism Ltd. They form part of your booking alongside the written quote, and where the quote says something different, the quote wins.

01 ✶ Booking and deposit

A date is held once the deposit is received and not before. Verbal or emailed agreement to a quote is not a booking. Deposits are 50 percent for all work and are non refundable except where clause 04 applies.

02 ✶ Payment

The balance is due within 14 days of delivery unless the quote says otherwise. Prices exclude travel outside of London, studio hire, props, talent, full production and styling unless itemised. Late payment may attract statutory interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998, for commercial clients.

03 ✶ Cancellation by you

More than 40 days before the date, the deposit is partially refunded (50 percent) and nothing further is owed. Between 39 and 7 days, the deposit is retained in its entirety and nothing further is owed. Between 7 days and 48 hours, half of the final fee is payable. In the case of cancellation made with less than 48 hours notice, the full fee is payable, because the date can no longer be resold. One free move of the date is offered if requested more than 7 days ahead and a suitable alternative is available.

04 ✶ Cancellation by me

If I cannot attend through illness, accident or anything else outside my control, I will first try to supply a colleague of comparable standard at no extra cost to you. If that is not possible, all money paid is refunded in full. Liability is limited to the fees paid, which is the normal position in this trade and the reason event organisers carry their own insurance.

05 ✶ On the day

Please supply a schedule, a contact on site, and any list of people or moments that must be photographed. Safe access, and reasonable breaks on shoots longer than five hours, are the client's responsibility. Time lost to a delay outside my control does not extend the booked hours. Additional hours are charged at the rate on the quote.

06 ✶ Copyright and licence

Copyright in every image and film remains with Raheem James at all times, which is the default position under the Copyright, Designs and Patents Act 1988. What you buy is a licence to use the work.

Private clients receive an unlimited personal use licence, including printing and posting online. Corporate and commercial clients receive the licence written on the quote, which by default covers owned and organic channels in the UK for 12 months. Paid media, out of home, packaging and worldwide use are priced separately and can be added at any time. Images may not be resold, sub licensed or supplied to a third party for their own promotion without agreement. Please do not crop, filter or otherwise alter delivered images for publication. Ask and I will supply the version you need. A credit is appreciated wherever it is practical and is required for editorial use.

07 ✶ My own use of the work

I may show delivered work in my portfolio, on this site, on social media and in submissions for awards. If your work is confidential, embargoed, or involves people who should not be shown, say so in writing before the shoot and it will be excluded. An embargo period can be agreed instead of a full exclusion.

08 ✶ People in the pictures

Where an event is being photographed, telling attendees is the organiser's responsibility, normally through the registration process and signage at the door. Anyone who asks me directly not to be photographed will not be. If a frame needs removing after delivery, tell me and it goes.

09 ✶ Delivery and storage

Preview sets and full galleries are delivered on the timings stated on the service page or the quote. Gallery links stay live for 14 days. Download and back up your own copies within that period. Original raw files are retained for 6 months and are not supplied, because the edit is part of the commissioned work.

10 ✶ Editing

Delivered images are colour graded and retouched to the standard shown on this site. Retouching removes the temporary and keeps the permanent. Reshaping a face or a body is not offered. Additional retouching beyond the included finals is quoted per image.

11 ✶ Complaints

Tell me within 14 days of delivery and I will put right anything that is reasonably within my control. Taste is not a fault: a difference of opinion about an artistic choice already agreed in the brief is not grounds for a refund.

13 ✶ Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
